Form 1099-NEC, Nonemployee Compensation, is an IRS information return filed by businesses to report payments for services to contractors and freelancers. It was reintroduced in 2020 to separate contractor payment reporting from the 1099-MISC and restore the January 31 deadline.
Who Files It
Any business or individual that paid an independent contractor, freelancer, or self-employed worker $600 or more for services during the calendar year must file a 1099-NEC. This includes attorneys paid for legal services, even if they are incorporated.
The Three Copies
Copy A goes to the IRS. Copy B goes to the contractor (must be furnished by January 31). Copy C is the payer's record copy. Some versions also include Copy 1 for state filing and Copy 2 for the recipient's state return.
Box 1 — The Key Box
Box 1 is where you report the total nonemployee compensation — the gross amount paid for services before any deductions. Include all payments made during the calendar year, not just the last payment. Do not include reimbursed expenses if tracked separately.
