Frequently Asked Questions — Form 1099-NEC

What is Form 1099-NEC?

Form 1099-NEC, Nonemployee Compensation, is an IRS information return that businesses use to report payments of $600 or more made to independent contractors, freelancers, and self-employed individuals during the tax year. The NEC was separated from 1099-MISC in 2020 to restore a January 31 filing deadline for nonemployee compensation.

Who files Form 1099-NEC?

Businesses and individuals who paid an independent contractor, freelancer, or self-employed person $600 or more during the calendar year must file a 1099-NEC. The payer (your business) files it with the IRS and gives a copy to the contractor. The contractor uses it to report their income on Schedule C.

What is the deadline to file Form 1099-NEC?

The 1099-NEC deadline is January 31 — both for filing with the IRS and for furnishing Copy B to the recipient. This is a firm deadline with no automatic extension. Late filing penalties range from $60 to $630 per form depending on how late the filing is.

What is the $600 threshold?

You must file a 1099-NEC for any contractor you paid $600 or more for services in a calendar year. Payments below $600 do not require a 1099-NEC, but the contractor still owes self-employment tax on that income and must report it.

What's the difference between 1099-NEC and 1099-MISC?

Form 1099-NEC is for nonemployee compensation — contractor and freelancer service payments. Form 1099-MISC covers other miscellaneous income: rents, royalties, prizes, attorney fees, and other non-service payments. Before 2020, nonemployee compensation was reported on 1099-MISC Box 7.

Do I need to file a 1099-NEC with my state?

Many states require a 1099-NEC filing with the state tax agency in addition to the IRS. Some states participate in the IRS Combined Federal/State Filing program, which automatically forwards the federal filing to the state. Check your state's department of revenue for specific requirements.

Can I e-file the 1099-NEC?

Yes — and if you're filing 10 or more information returns total, the IRS requires e-filing. You can submit through the IRS FIRE system or an approved transmitter service. PDF Edit produces the filled paper form, which you can use for paper filing or as a reference when entering data into an e-file platform.

Is this the official IRS Form 1099-NEC?

Yes. PDF Edit loads the 1099-NEC PDF directly from irs.gov. We do not recreate or host a separate version — you're filling the same document the IRS publishes.

About Form 1099-NEC

What It Is

Form 1099-NEC, Nonemployee Compensation, is an IRS information return filed by businesses to report payments for services to contractors and freelancers. It was reintroduced in 2020 to separate contractor payment reporting from the 1099-MISC and restore the January 31 deadline.

Who Files It

Any business or individual that paid an independent contractor, freelancer, or self-employed worker $600 or more for services during the calendar year must file a 1099-NEC. This includes attorneys paid for legal services, even if they are incorporated.

The Three Copies

Copy A goes to the IRS. Copy B goes to the contractor (must be furnished by January 31). Copy C is the payer's record copy. Some versions also include Copy 1 for state filing and Copy 2 for the recipient's state return.

Box 1 — The Key Box

Box 1 is where you report the total nonemployee compensation — the gross amount paid for services before any deductions. Include all payments made during the calendar year, not just the last payment. Do not include reimbursed expenses if tracked separately.

1099-NEC vs. 1099-MISC

Use 1099-NEC for service payments to contractors. Use 1099-MISC for rents, royalties, prizes, medical payments, crop insurance proceeds, and attorney gross proceeds. Most payments that were formerly in 1099-MISC Box 7 now go on 1099-NEC Box 1.
