What is Form 1099-MISC?
Form 1099-MISC (Miscellaneous Information) is an IRS information return used to report certain types of income paid to others. It covers rents, royalties, prizes and awards, medical and healthcare payments, crop insurance proceeds, and gross proceeds paid to attorneys. Since 2020, nonemployee compensation (contractor payments) moved to the separate Form 1099-NEC.
Who must file a 1099-MISC?
Businesses and self-employed individuals must file a 1099-MISC when they pay at least $600 in a calendar year in: rents, prizes and awards, medical or healthcare payments, or attorney fees. The threshold is lower for royalties — you must file when you pay $10 or more. Payments to corporations are generally exempt, with notable exceptions for medical and attorney payments.
What is the 1099-MISC deadline?
The recipient copy (Copy B) must be sent by January 31. Copy A filed with the IRS is due February 28 for paper filers or March 31 for electronic filers. If you have 10 or more information returns in aggregate, you are now required to file electronically.
What's the difference between 1099-MISC and 1099-NEC?
Starting in tax year 2020, the IRS revived Form 1099-NEC specifically for nonemployee compensation — payments to independent contractors, freelancers, and self-employed individuals for services. Form 1099-MISC now handles the remaining miscellaneous payments: rents, royalties, prizes, medical payments, and similar. If you're paying a contractor for work, use 1099-NEC. If you're paying a landlord rent, use 1099-MISC.
Do I need a 1099-MISC for rent paid to a corporation?
Generally no. Payments to C-corps and S-corps are exempt from 1099 reporting in most cases. However, medical and healthcare payments and gross proceeds to attorneys are reportable regardless of entity type. Always confirm the recipient's entity type with a Form W-9 before deciding whether to file.
What are the penalties for not filing a 1099-MISC?
Late or missing 1099s carry penalties ranging from $60 to $330 per form, depending on how late the filing is. The penalty cap is $3.3 million per year for most businesses. Intentional disregard of the filing requirement raises the per-form penalty to a minimum of $660 with no annual cap.
